  1. INTRODUCTION

This Privacy Policy (“Privacy Policy”) will detail Media Arena Ltd ("Company", "we" or " us") data collection and privacy practices, in the course of downloading and using the Product and Services (as defined in our End User License Agreement (“EULA”)). This Privacy Policy will provide transparent information regarding our privacy practices, as required, among others, according to the EU General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”).

Please carefully review this Privacy Policy before you download, access or use the Product and Services. This Privacy Policy is integral part of our EULA; therefore, definitions herein shall have the same meaning as defined in the EULA.

  1. AMENDMENTS

We reserve the right to periodically amend or revise this Privacy Policy at our sole discretion; such changes will be effective immediately upon the publication of the revised Privacy Policy. The last revision date will be reflected in the "Last Modified" date at the bottom of this Privacy Policy. In the event of material changes that will adversely affect your rights, we will make best efforts to provide an applicable notification.

  1. TYPES OF INFORMATION COLLECTED AND LAWFUL BASIS

When you download the Product and use the Services, we will gather and processes the below data. The data that will be processed will include non-identifiable aggregated information ( "Non-Personal Data") transmitted from your device, as well as data that identifies a user or may identify a user, as defined under applicable laws (“Personal Data”).

Our lawful basis for collection of Personal Data, as required under the GDPR, is as detailed below:

  1. We or our third-party partners (for example search feed providers or other advertisers) may use cookies for advertising purposes, which, subject to applicable law requirements, we will request your consent;

  2. We process certain online identifiers for operation and functionality purposes, subject to our legitimate interest;

  3. If you voluntarily communicate with us, we will process your contact details and information you provide for the purpose of performing our contract with you.

If you download and use our Product and use the Services, we will collect technical data transmitted from your device, such as:

* aggregated use of the Service;

* Internet Service Provider.

We will use this data for operation purposes, as well as in order to further enhance and develop the Services, as well as for internal statistics.

IP Address

If you download and use our Product and use the Services, we will collect your IP address.

Online identifiers are processed under our legitimate interest as it is necessary for operating and providing the Services, to further improve, refine, customize and develop the Product and Services, as well as to perform research, and conduct associated analytical and statistical activities, detect fraud, security or technical issues in connection with the Services and calculate our business partners’ payments. Please note that, we will not store your IP address as is, rather use industry common practices to anonymize this data.

Your IP address may be used to determine your approximate location (e.g., country) and display relevant advertisements.

Search Queries

We, or our third-party advertisers (providing the search feed) may collect search related data. For example, the URLs of websites that you visited may be processed. This data, in most cases is aggregated Non-Personal Data, however, sometimes web browsing data contains terms that could be considered to be Personal Data. Please note that this data is deleted shortly following collection.

We will use this data for the purpose of providing you with relevant advertising based on previous searches.

Contact Information

If you voluntarily contact us for any inquiry or request for support we will process your contact details (email. Name, etc.), and in certain circumstances, we will also store our correspondence.

We will process this information for the purpose of responding to your inquiries and provide you with the requested service, information or support.

The correspondence will be stored in the event we believe it is needed, for example, in the event of future claim, to provide you with support, or to improve our services.

  1. SHARING DATA WITH THIRD PARTIES

We will share Personal Data collected solely in the following events:

  1. We may share your Personal Data in order to comply with any applicable law, legal process or governmental request as well as for the purpose of enforcing our agreements and policies, establish, exercise or defend our rights and third party’s rights, and any applicable needed action in this regard. In addition, we may share your information to prevent or detect illegal activities, wrongdoing, and suspected fraud.

  2. We may disclose Personal Data to our service providers so that they can perform requested services on our behalf. We prohibit such service providers from using your Personal Data for any purposes.

  3. We may share your Personal Data to third parties when you provide your consent to a particular disclosure. However, if we do share your information based on your consent, following such disclosure, the information shared will be subject to such third party’s privacy practices which might differ from our practices detailed herein.

  4. We may share your Personal Data with a parent company, subsidiaries, joint ventures, or other companies under common control ("Affiliated Companies") solely if and when applicable or necessary. In addition, we may share information, in the event of a corporate transaction (e.g. sale, merger, consolidation, etc.), provided however, that our Affiliated Companies or acquiring company will be subject to the obligations detailed herein with respect to your Personal Data;

  5. We may share online identifiers with our business partners (as detailed above), for the purpose of fraud detection and calculating payments.

  1. THIRD PARTY PRIVACY PRACTICES

This Privacy Policy does not cover third-party privacy practices, even if their services and links are available through our Product and Service. Those privacy practices may differ from ours, and we do not control the privacy and security practices of these third parties. We will not be responsible or liable to such third parties’ acts or omissions.

  1. NO OBLIGATION TO STORE INFORMATION

Nothing in this Privacy Policy is interpreted as an obligation to store information, and we may, at our own discretion, delete or avoid from recording and storing any and all information.

  1. TRANSFER OF DATA

We may store or process the data we collect in the United States or in other countries, including the European Economic Area (" EEA"). If you are a resident of the EEA we will take the measures required under applicable laws to ensure that your information receives an adequate level of data protection upon its transfer outside of the EEA. If you are a resident of a jurisdiction where transfer of your data requires your consent, then your consent to this Privacy Policy includes your express consent for such transfer of your Personal Data.

The Product and Services may include the use of widely known technology known as “cookies”. The cookies may be used for us or by our third-party business partners for various purposes, including, for example, in order to make the Product work more efficiently, as well as to provide the Services and functionalities for users. We use industry common measures in order to keep the information we process secured. Although we make best efforts, 100% security cannot be provided. We will not be responsible for unauthorized or unlawful that is not under our control. Unless you instruct us otherwise and subject to applicable laws, we retain the information we collect for as long as needed to provide our Services and to comply with our legal obligations, resolve disputes and enforce our agreements if applicable.
